ARTHUR 'BOOTS' FERGUSON 'Boots' Ferguson has provided legal services for planned unit developments and recreational and resort projects for the past 25 years. Work in this area has given him a unique command of the legal and practical issues presented by complex land use projects, including overseeing and performing legal work in the areas of annexation and annexation agreements, land use and zoning processes and approvals, 1041 hearings and approvals, the use and formation of special districts and associated election matters, water rights and water supply and waste water service contracts, easements, affordable housing, wildlife issues, wildland fire issues, transportation issues, and the negotiation of the mitigation of development impacts. Mr. Ferguson has worked on numerous large land development projects involving local, state, and federal issues. Mr. Ferguson has also performed work in connection with the recreational industry including base area developments of hotel, condominium, retail, and residential components, sponsorship contracts, television agreements, FIS and USSA agreements, trademarks, professional athlete agreements, ticket disclaimers, marketing plan review, advertising agency contracts, merchandising contracts, lift agreements, construction and facilities maintenance agreements, maintenance equipment purchase agreements, waivers and releases, environmental issues, rental contracts, restaurant lease agreements, labor relations, tax benefits, and ad valorem tax matters. Mr. Ferguson is special counsel to the Colorado Ski Country U.S.A., and has worked on behalf of the National Ski Areas Association and the Rocky Mountain Lift Association and serves on the boards of directors of the Tenth Mountain Division Hut Association, Alfred F.
